One: Scope and acceptance
These Terms of Use apply when you access, browse, register for, purchase, download, subscribe to or otherwise use products and services provided by FermatMind through websites, web pages, applications, mini programs, interfaces, event pages or other official channels, collectively the ‘Services’.
If you do not agree to all of these Terms, do not use the Services. Continuing to access them, register an account, submit answers, purchase reports, use features or otherwise actually use the Services means you have understood and accepted these Terms.
If you use the Services on behalf of an organization, school, institution or other entity, you represent and warrant that you are authorized to accept these Terms and related rules on its behalf and ensure its compliance. If you lack that authority, you bear the resulting responsibility yourself.
Two: Updates and notices
FermatMind may update these Terms for product changes, regulatory requirements, operational arrangements or risk controls. Updated versions will be published on the official website or in the product, with reasonable notice of their effective date.
Unless mandatory law requires otherwise or we make an explicit commitment otherwise, updates take effect on publication or the date stated in the notice. Continuing to use the Services after an update takes effect constitutes acceptance. If you disagree, stop using the relevant Services.
FermatMind may send important service notices through on-site notices, product pop-ups, registered email, text messages, system messages, order pages or other reasonable means.
Three: Accounts, eligibility and minors
You should have the civil capacity needed to use the Services. If you lack full civil capacity, use them with a guardian's consent, accompaniment or guidance; the guardian bears corresponding responsibility for the relevant actions.
Provide truthful, accurate, complete and current information when registering or using accounts, and safeguard login credentials. Do not lend, rent, buy, sell, transfer or share accounts. You generally bear risks and losses arising from inadequate safeguarding.
For Services involving minors under fourteen, FermatMind may require explicit guardian consent and apply additional age identification, feature restrictions, guardian reminders or content boundaries.
Four: Service content and usage boundaries
Services may include, without limitation, assessments concerning personality, careers, interests, abilities, emotions or relationships; report generation; development suggestions; content reading; review records; and related tools, interfaces and paid services. Actual pages govern each feature's content, scope, availability and charges.
Results, charts, type explanations, career and development suggestions, content recommendations and any automatically generated interpretations primarily support self-observation, communication and development. They do not constitute medical diagnoses, psychotherapy, educational admission opinions, employment decision opinions, legal advice, investment advice or conclusions of other professional services.
You understand and agree that people are complex and changeable, and assessment results and interpretations cannot be guaranteed completely accurate, fully suitable or applicable in every context. Use the Services alongside your real circumstances, independent judgment and professional advice where necessary.
Five: Orders, payment and digital delivery
Some features may be free; others may require purchase, subscription or unlocking. Payment pages, order pages or purchase explanations govern specific prices, billing methods, taxes, access duration, automatic renewal arrangements if any, and delivered content.
After you submit an order and complete payment, FermatMind will deliver digital reports, access rights, subscription benefits or other corresponding content as described on the page. Reasonable delays may arise from system risk controls, network conditions, payment channel problems, account security verification or maintenance.
Consult ‘Other Policies’ and purchase page explanations for supplementary rules on refunds, duplicate charges, subscription cancellation, abnormal orders and digital delivery.
Six: User content, answers and authorization
You may submit answers, text, materials, feedback, images, files, reviews or other information to FermatMind, collectively ‘User Content’. You must hold lawful rights or necessary authorization for User Content, which must not infringe third parties' lawful rights and interests.
Between you and FermatMind, you retain your lawful rights in your User Content unless law or a separate agreement provides otherwise. You authorize FermatMind to process it within the necessary scope to provide services, generate reports, save history, handle orders, verify security, fix problems, improve products and fulfill legal obligations. The Privacy Policy governs specific data processing.
For third-party personal information, minors' information, internal organizational information or other sensitive content, ensure lawful, sufficient and demonstrable authorization and bear the resulting responsibility.
Seven: Intellectual property and limited license
Intellectual property and related rights in FermatMind and its Services, including page designs, item structures, report templates, content expression, visual assets, trademarks, wordmarks, graphics, code, models, organized data, databases, audio, video, charts and related materials, belong to FermatMind or the relevant rights holders, except portions lawfully belonging to you or third parties.
Subject to these Terms and related rules, FermatMind grants you a personal, limited, non-exclusive, non-sublicensable, revocable license to access and use the Services for lawful, non-misleading purposes. Unless expressly permitted by law or by FermatMind in writing, do not copy, distribute, adapt, sell, rent, publicly display, reverse engineer, scrape in bulk or otherwise exploit service content.

Eight: Prohibited conduct
Do not engage in unlawful conduct, infringement, fraud, abuse, interference with system security or harm to others' rights. The following conduct is generally prohibited:
- Using false identities, misappropriating others' information or impersonating FermatMind, its partners, employees, researchers or authorized organizations.
- Using crawlers, scripts, unauthorized plug-ins, interface abuse, bulk registration or other automation to scrape, copy, test, interfere with or circumvent service restrictions and security measures.
- Bypassing payment mechanisms, access controls, usage limits, risk controls or other protections.
- Using the Services for unlawful activities, harassment, insults, discrimination, deception, fraud, harmful content distribution or infringement of third-party rights.
- Presenting results as formal evaluations of others, bases for decisions or discriminatory tools, particularly in high-risk settings such as hiring, education, medicine, finance, insurance, law or public services.
If FermatMind reasonably believes you engage in this conduct, we may issue warnings, restrict features, suspend services, cancel orders, freeze accounts, remove relevant content or pursue liability according to law.
Nine: Organizational and business use, and high-risk restrictions
Organizations, schools, training institutions, research institutions and other entities intending internal use should separately agree with FermatMind according to purpose, scope and risk. Separate agreements or written rules govern team profiles, bulk assessments, organizational authorization, research partnerships, data interfaces, customized reports or administration features.
Under no circumstances does FermatMind encourage or agree to using results as the sole basis for hiring, elimination, promotion, salary setting, admission, rewards or punishment, lending, insurance, medical or judicial judgments, or other matters affecting major individual rights and interests. Where organizational settings genuinely need results as a reference, human judgment, adequate explanations, appeal mechanisms and appropriate options to withdraw must remain.
FermatMind reserves the right to refuse high-risk partnerships, restrict calls to high-risk features, request additional compliance materials or terminate inappropriate use.
Ten: Third-party services and external links
Services may integrate third-party payments, login, support, analytics, cloud services, content distribution, email, text messaging or other external services. Third parties independently provide these services; their availability, stability, data processing and service rules are governed by third-party terms.
FermatMind makes reasonable efforts to choose suitable partners, but does not automatically bear responsibility for third-party services' own actions, failures or security incidents, unless law or a separate agreement provides otherwise.
Eleven: Service changes, interruptions and termination
For system security, compliance, service quality or business arrangements, FermatMind may reasonably change, upgrade, suspend, withdraw or terminate some services, features, items, models, report wording or presentation methods.
Where law permits, FermatMind may suspend or terminate all or part of the Services if you violate these Terms, related policies or applicable law, or your use risks the platform, other users, third parties or the public interest.
You may also stop using the Services and apply through provided routes to close accounts, cancel subscriptions or delete relevant information. Some provisions on orders, payments, disputes, data retention and legal obligations may continue after termination.
Twelve: Disclaimers
To the fullest extent permitted by applicable law, FermatMind provides the Services as is and under existing conditions. We strive to improve stability, accuracy and comprehensibility, but do not guarantee uninterrupted operation, absolute freedom from error, complete suitability for a particular purpose or full satisfaction of your subjective expectations.
Assessments and interpretations concerning personality, careers, interests, abilities, emotions and relationships inherently have model limitations, contextual differences and interpretation errors. Do not treat outputs as unquestionable truth or substitute them for in-person professional services or high-risk formal procedures.
If you experience persistent psychological distress, thoughts of self-harm, severe emotional difficulties, clinical symptoms or other urgent risks, do not remain with online assessments or report reading. Contact family, a doctor, counselor, hospital or local emergency support resources promptly.
Thirteen: Limitations of liability
Within applicable law, FermatMind is not liable for indirect or incidental losses, loss of expected benefits, data loss, loss of goodwill or other consequential losses arising from your use or inability to use the Services, except for intentional misconduct or gross negligence, liability that law expressly prohibits limiting, or a separate written agreement.
Where law permits, FermatMind's aggregate liability for a single matter or all claims related to these Terms is capped at the amount you actually paid FermatMind for the relevant paid Services in the twelve months before the dispute arose. If you paid no fees, the minimum liability permitted by law applies.
Fourteen: Governing law, disputes and contact
Unless mandatory law requires otherwise or a product page expressly provides otherwise, the laws of the People's Republic of China govern the formation, validity, performance, interpretation and dispute resolution of these Terms.
For disputes arising from these Terms or use of the Services, both parties should first negotiate amicably. If negotiations fail, either party may bring proceedings before the people's court with jurisdiction at the location of the operating entity providing the relevant Services.
